to ignore laws he doesn't agree with or rewrites them as in the case of obama care or posting on the white house blog. let's talk about it now with evan bayh and senator jon kyl. let's start with you, senator kyl. the sentiment has not been only for president obama but any president that would rewrite laws by giving speeches, what's the danger there? >> there was concern as he reached out in the foreign policy area. presidents send to do that. what is different about obama is that i think probably at least since fdr he has pushed the limits of executive authority on domestic matters to the limits. on immigration reform he's decided not to and all welfare laws, education, anti-drug laws, he has simply decided not to enforce divisions of the law and the biggest example is obama care where the employer mandate was delayed a year. if you like your insurance, you get to keep it well. turns out the law says, no, you can't. so he directed the state incidents to direct the insurance companies to go ahead and provide the same policies they had had before and also there's no subsidy provided for the

obama's new health fix-it man. a post just went up. can you talk about that? be one of the to white house'lobbyists to capitol hill and was working with congress when they pass the affordable care act. this appears to be a response to a freak out on capitol hill among democrats regarding the issue of people's policies being canceled because they did not meet the rules. may be the white house felt they had some of who is dedicated to this issue and had worked on getting a bill passed with the democratic lawmakers, maybe they could quell this discontent before a republican bill coming up on the house floor. that is what was going on a few weeks ago. from let's go to dan anchorage, alaska. caller: this is dan. my question is about the in theon of dedicated states that turned it down. who decides whether a state turns it down? is if the governor or the legislature of the state? is there any way if the state turned it down that they can change their mind and take it? guest: the answer is it depends on the state. usually the legislature has to pass a bill and the governor has to sign it.

i was a little bit confused when he said no one has accused president obama of being inclined to engage in a war without a declaration. i was in court with members of this committee saying exactly that in the conflict and what disturbed us is the white house came back and said the reason that we don't need a declaration of war is the president defines what it is and he's simply saying this isn't a war. when we talk about the danger this is a danger of a different kind. not only did a express language of the constitution, that this administration through these acts and through the large numbers of attacks is returning the world to a state of nature. we are taking dumb criminal international principles that have governed this world that respect the territorial limitations. i spoke to the nato parliamentarians and i told them you will blow the the day that you and force the position that they can take unilateral action when somebody vaporizes somebody in london. >> my time is about to run out three and let me give each of you this question. the president ordered and more a -- and
